Health Care Battle Finally Gets Its Day(s) in Court
By Alexis Simendinger"Inside the building, Chief Justice John Roberts said in oral arguments that Congress created a requirement that people must be insured, as well as an enforcement mechanism intended to have teeth. “It’s a command,” he said, according to a transcript released Monday by the court. “A mandate is a command. . . . What happens if you don’t follow the mandate? . . . It seems very artificial to separate the punishment from the crime.”
The justices, despite the charged atmosphere outside, sounded eager to move ahead rather than defer a ruling about what the law requires and whether its key elements comport with the Constitution."
